THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO YOU IF AND INSOFAR AS IT CONFLICTS WITH ANY APPLICABLE LAWS.
10. Indemnification
You agree to indemnify, defend and hold harmless IBCOL and its affiliates, subsidiaries, officers, directors, employees, agents, licensors, distributors and suppliers from and against all losses, liabilities, expenses, damages and costs, including reasonable attorneys' fees and court costs, arising or resulting from any violation of these Terms of Use or any activity related to your Internet account (including but not limited to negligent or wrongful conduct), by you or any other person accessing the Site using your Internet account. If you cause a technical disruption of the Site or the systems transmitting the Site to you or others, you agree to be responsible for any and all losses, liabilities, expenses, damages and costs, including reasonable attorneys' fees and court costs, arising or resulting from that disruption.
11. Miscellaneous
These Terms of Use and your use of the Site shall be governed by and any and all disputes relating hereto shall be resolved in accordance with the laws of the Federal Republic of Germany, excluding its conflict of laws rules and application of the United Nations Convention on the International Sales of Goods (CISG).
The Site and the individual pages contained therein are administered, controlled and operated by IBCOL from its offices in Haar / Germany and are meant to fully comply with German laws. IBCOL makes no representation that the Site is appropriate and available for use at locations outside Germany. If you access the Site from outside Germany, you will exclusively be responsible for compliance with all applicable laws. If any material on this Site, or your use of the Site, is contrary to the laws of the place where you are when you access it, you must not access and use the Site. Furthermore, you must not use or export materials on or from this Site in violation of German or other relevant export laws and regulations.
If any provision of the Terms of Use is found to be unlawful, void or unenforceable, the remaining provisions of the Terms of Use shall remain in full force and effect.
The Terms of Use are meant to constitute the entire agreement between you and IBCOL regarding all aspects of your use of this Site.
Any lawsuits arising from or relating to the Terms of Use and / or the Site shall be brought to the civil courts (Landgericht München I) in Munich / Germany, and you hereby irrevocably submit to the exclusive personal jurisdiction of such courts for such purpose.
